Customer Disclosure Agreement

Neighbourhood Bids • Effective date: [DATE] • Version: [VERSION NUMBER]

This Customer Disclosure Agreement ("Agreement") is between you ("Customer," "you") and Neighbourhood Bids ("Platform," "we," or "us"). It applies whenever you choose to award a project through the Platform to a professional who has not uploaded a current Certificate of Insurance (COI) or does not carry the Platform's insurance badge at the time you award the job.

1. Your choice of provider

Neighbourhood Bids is a marketplace that lets you work with both insured and uninsured professionals. You are free to choose a provider based on price, reviews, availability, or any other factor. If you select a professional who does not carry the insurance badge and has not uploaded a COI, you must acknowledge and accept the risks described in this Agreement before the award is recorded.

2. No insurance verification for uninsured providers

The Platform verifies insurance only for professionals who carry the insurance badge or who have uploaded a COI that the Platform has accepted. For professionals without a COI or insurance badge, the Platform does not verify, and does not represent, that the professional carries general liability insurance, workers' compensation, commercial auto, professional liability, or any other coverage. An uninsured provider may have no insurance of any kind available to you for this project.

3. Risks of working with an uninsured professional

By awarding a job to a professional who is not insured, you acknowledge and accept that:

  • The professional may not carry general liability insurance or workers' compensation coverage for this project.
  • If property damage, personal injury, or incomplete or defective work occurs, you may have no insurance recovery and may need to pursue the professional directly, through your own homeowner's or other insurance, or through the courts.
  • Your own insurance may not cover damage or injury caused by an uninsured contractor, and a claim could affect your premiums or coverage.
  • The Platform is not the contractor, is not a party to your contract with the professional, and is not responsible for the professional's acts or omissions.
  • The Platform does not guarantee the professional's workmanship, payment practices, licensing, or compliance with law.

4. Your responsibility before work begins

You are solely responsible for confirming any insurance, license, permit, or other qualification you require before work begins. You may ask the professional to obtain and upload a project-specific COI listing you as certificate holder, or to provide additional-insured status, before allowing work to start. If the professional cannot or will not do so, you may decline to proceed and choose an insured professional instead.

5. Independent contract and platform role

Your agreement for services is directly with the professional you select. The Platform provides introductions, messaging, and bidding tools but does not perform the work and is not your contractor, agent, or insurer. Awarding a job through the Platform does not make the Platform liable for the professional's performance, insurance status, or any loss you may suffer.

6. Disputes

If a dispute arises with an uninsured professional, the Platform's dispute tools may help you communicate, but the Platform cannot compel payment, repairs, or insurance recovery that does not exist. You may need to pursue legal remedies against the professional directly. The Platform's dispute process is administrative and does not constitute a legal determination or a guarantee of any outcome.

7. Acknowledgment

By checking the agreement box and awarding the job, you confirm that you have read and understand this Agreement, that you have been advised to choose an insured professional, and that you voluntarily accept the risks of working with a professional who does not carry insurance or the insurance badge. The Platform records the date and time of your acknowledgment on the job record.

8. Changes and governing law

The Platform may update this Agreement. Material changes will be communicated before they take effect, with renewed acceptance obtained where required. North Carolina law governs this Agreement except where mandatory law requires otherwise. This choice does not displace any consumer-protection, licensing, insurance, or other mandatory requirement that applies at the project location. If one provision is unenforceable, the remaining provisions continue to the extent permitted by law.

This disclosure is presented alongside, and does not replace, the Platform's Terms of Service and Privacy Policy.
